General Terms & Conditions
By accessing or using this website (the “Site”), which is hosted by HMI INC, and located at 57 Providence Highway, Norwood, MA 02062 (“HMI”) and Transtar Industries, (“Company”, “us”, “our”, and “we”).”), collectively (“we” or “us”), you acknowledge that you have read, understood and agree to be legally bound by these terms and conditions, including without limitation the terms and conditions set forth below, (collectively, the “Terms”) in connection with the Transtar transend Reward Points (“Reward Reward Points”) Program (the “Program”); agree to comply with all applicable laws and regulations; and represent and warrant that you are at least 18 years of age and have obtained any and all permissions necessary to enter into and to be bound by these Terms. You understand and agree that Company and HMI will treat your access to and use of the Site as acceptance of these Terms from that point onwards.
Participation is not mandatory. Participation in the Program is subject to these Terms and any additional terms provided to you. We reserve the right, in our sole discretion, to change, modify, add or remove portions of these Terms at any time. You should check these Terms periodically for changes, through your continued use of the Site after we post any changes to these Terms, you are agreeing to accept those changes, whether you have reviewed them. These Terms may be supplemented by additional terms and conditions pertaining to specific content and activities or Rewards. Specific additional terms, conditions and other program guidelines may be contained on the Site and are hereby incorporated by reference into these Terms.
Program Eligibility
Access to this Site and participation in the Program is the sole discretion of Company.
Reward Points
All point values displayed on the Site are for Program administration purposes only. Reward Points have no cash or monetary value. Reward Points cannot be used as payment for or credits against any obligations to Company. Participant’s right to Reward Points accrues only upon redemption, and not at any time prior thereto. Unredeemed Reward Points are not obligations owing to you or property belonging to you and shall not in any circumstances be considered to have been abandoned or otherwise reportable or escheatable within the meaning of the abandoned property laws of any state or jurisdiction If you are disqualified from further participation in the Program, all unredeemed Reward Points shall be unredeemable and no additional Reward Points shall be available.
Good Standing
Program participants must be contractors current and in good standing with Company at the time of purchase in order to receive Reward Points. Delinquent accounts may be subject to termination in the program and/or loss or adjustment of Reward Points. For purposes of these Terms, “good standing” means that you are not late or otherwise delinquent on any outstanding payment owed. This is determined by the due date on the invoice.
Redemptions & Rewards
To redeem your Reward Points and receive an award, you must be enrolled in the Program. You may redeem Reward Points for awards currently featured on the Site at the time of redemption. Shipment times vary and are noted on the Site upon redemption. There may be specific terms that are applicable to an award, please review those additional terms that are presented to you at the point of redemption prior to completing your request to redeem. When redeeming Reward Points, participants will not be able to redeem for any awards that exceed their current point balance.
Taxes
Awards received may be considered taxable benefits depending on the laws, rules, and regulation in effect in the respective countries where the Program is available and your jurisdiction of residence. Any federal, state, or local income tax liability and any other federal, state, or local taxes are the responsibility of the participant. Award offers are void where prohibited by law. While every effort has been made to ensure that the data on this Site is accurate, we are not responsible for errors or omissions with respect to the Site.
Miscellaneous
Transtar reserves the right to cancel, discontinue this Program at any time as determined by Company in its sole discretion.
Transtar reserves the right to terminate the eligibility of a participating company or participant. Transtar reserves the right to cancel, terminate or suspend the Program or any part of the Program should any non-authorized intervention or other cause beyond Transtar’s control corrupts or impairs the security, legality, administration, fairness or operation of the Program as determined by Transtar in its sole discretion, and if terminated, at its discretion.
Transtar reserves the right to disqualify any Program participant and remove all associated Reward Points if, in its sole discretion, a Program participant violates any federal, state, local, or foreign laws, rules, or regulations, or if the Participant violates, shows disregard for, or attempts to circumvent, these Terms. If Program participant is suspected of fraud or other unlawful conduct, we will at a minimum place a hold on the Program participant’s account and redemption activity during a review period. Company and HMI reserves the right, at their discretion to rectify any transaction or redemption for any error or omission.
